Maricopa County Board responds to contempt filing by Recorder Heap

Maricopa County Board of Supervisors Chair Kate Brophy McGee issued a statement in response to a contempt-of-court filing by Recorder Justin Heap. In the statement, she said, "At every turn, Recorder Heap and his attorneys have sought confrontation rather than collaboration."

McGee said that more than a week ago, the board formally asked Recorder Heap to meet in person to resolve outstanding issues related to the administration of the 2026 Primary and General Elections. She said he did not respond. Vice Chair Lesko also contacted the Recorder individually via voicemail and text seeking a discussion, but she said he did not respond.

McGee said Heap has filed a series of court actions that should concern every Maricopa County voter. She said, in recent days, Heap has threatened felony prosecution of county elections staff for simply carrying out their assigned duties, and now he seeks civil contempt charges against the Board of Supervisors and an assessment of a $100,000 per day fine against county taxpayers. She reiterated that, at every turn, Heap and his attorneys have sought confrontation rather than collaboration.

McGee concluded by addressing elections staff and poll workers, saying she wants them to know the board has their back. She told voters that the Board of Supervisors remains committed to ensuring an elections process that is secure, transparent, accurate and conducted in accordance with federal and state law.
