Maricopa County Files Motion Dismissing Heap Suit

Maricopa County officials have taken legal action in response to Recorder Justin Heap's lawsuit against the Board of Supervisors. According to County District 2 Supervisor Thomas Galvin, the board has instructed outside legal counsel to file a motion to dismiss the lawsuit and to submit a counter claim asking the court for declaratory relief.

Supervisor Galvin stated that board members had been negotiating in good faith with Recorder Heap over the past several months on a shared services agreement. The purpose of the agreement was to establish responsibilities for administering elections. However, the negotiations did not result in an agreement.

Galvin emphasized the importance of reaching an arrangement before the 2026 election cycle to ensure certainty and consistency in election administration.
